Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to contracts for the rental of guest rooms for accommodation and all other services provided by the provider to the guest. The provider’s services are provided exclusively on the basis of these General Terms and Conditions.

§ 2 Booking and confirmation

Please enter your booking requests via the booking enquiry form on the providers website or send them in writing to or by phonecall.

If we are able to provide you with the rooms you require for the desired period, you will receive written confirmation of the rooms booked from us. The reservation for the rooms is legally binding upon receipt of the booking confirmation (see § 3).

Furthermore, you can independently book your rooms bindingly via alternative booking platforms (under their own terms and conditions), where you will also receive a booking confirmation.

§ 3 Terms of payment

Payment is due on the day of arrival. If contractually agreed, companies may cover the costs (payment is made by invoice or company credit card).

Guests may pay their bills in cash or with credit and debit cards currently accepted by the provider without incurring any fees.

For online booking portals, payment details are specified by their own terms and conditions.

§ 4 Arrival and departure

The rooms are available on the day of arrival from 2:00 p.m. to 8:00 p.m. or by arrangement. Please be sure to let us know your expected arrival time at least 1-2 days before arrival. If you plan to arrive after 8:00 p.m., this must be arranged in advance. Keys are always handed over at the reception desk.

On the day of departure, rooms must be vacated by 10:30 a.m. or by arrangement.

§ 5 Rooms

The rooms are handed over by the provider in a neat and clean condition. Should any defects exist or occur during the rental period, the provider must be notified immediately. The guest is liable for any damage caused by them to the rental property or its contents, e.g., broken TV, damage to the floor or furniture. This also includes the cost of lost keys. The contents must be treated with care and respect. Moving furniture, especially beds, is prohibited. The guest is also liable for the actions of his fellow travelers. Damage caused by force majeure is excluded from this.

§ 6 Pets

Pets, dogs only, are allowed in the rooms for a daily rate. The guest is 100% liable for any damage, soiling, or similar.

§ 7 Stay

The room may only be used by the persons listed in the booking. If the apartment is used by more persons than agreed, a separate fee must be paid for them, which can be found in the daily price list.

Subletting and transferring the rooms to third parties is not permitted. The rental agreement may not be transferred to third parties. The guest agrees to the general terms and conditions and the house rules of Pension Wiesenau. The declaration of consent is made upon payment. In the event of violations of the general terms and conditions or the house rules, the provider is entitled to terminate the rental agreement immediately and without notice. There is no legal claim to a refund of the booking price or compensation.

§ 8 Cancellation by the guest

In the event of withdrawal from the rental agreement, the guest is obliged to pay compensation. Cancellation must be made in writing. The amount of compensation depends on the time remaining until the arrival date and is calculated as follows: 100% of the agreed booking price from 2 days before the arrival date or in the event of no-show.

We recommend taking out travel cancellation insurance.

§ 9 Cancellation by the provider

In the event of cancellation on our part due to force majeure or other unforeseeable circumstances (such as accident or illness of the hosts) as well as other circumstances beyond our control that make fulfillment impossible, liability is limited to reimbursement of costs. In the event of justified withdrawal, the customer shall not be entitled to claim damages – no liability shall be assumed for travel and hotel costs.

Withdrawal by the provider may take place after the start of the rental period without notice if the guest persistently disturbs other guests despite warnings or behaves in such a manner contrary to the contract that immediate termination of the rental agreement is justified.

§ 10 Liability of the provider

The provider is liable for the proper provision of the rental property within the scope of the duty of care of a prudent businessman. Liability for any failures or disruptions in the water or electricity supply, as well as events and consequences due to force majeure, is hereby excluded. The provider is liable for items brought in by the guest in accordance with the statutory provisions (§701 BGB).

§ 11 Written form

There are no agreements other than those listed in this contract. No verbal agreements have been made. The general terms and conditions are accepted with the booking confirmation.

§ 12 Limitation period

Claims by the guest against the provider shall generally become time-barred one year after the start of the statutory limitation period (§199 (1) BGB).

This does not affect claims of the guest arising from injury to life, limb, or health, as well as other claims based on intentional or grossly negligent breach of duty by the provider, a legal representative, or vicarious agent.

§ 13 Choice of law and place of jurisdiction

German law applies. The exclusive place of jurisdiction for legal action taken by the guest against the provider is the provider’s registered office. For legal actions brought by the lessor against merchants, legal entities under public or private law who do not have a general place of jurisdiction in Germany or who have moved their place of residence or habitual abode abroad after conclusion of the contract or whose place of residence or habitual abode is unknown at the time the action is brought, the registered office of the lessor is agreed as the exclusive place of jurisdiction.

§ 15 Severability clause

Should one or more provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose pursued by the invalid provision.

§ 16 Entry into force

The General Terms and Conditions of Pension Wiesenau entered into force on January 1, 2025, and hereby replace all previous General Terms and Conditions.
